Welcome to WhaleWatch ("the Service"). These Terms of Service ("Terms") are a binding agreement between you and WhaleWatch Analytics ("WhaleWatch," "we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
These Terms apply to all visitors, users, and others who access the Service. By using the Service, you represent that you have read, understood, and agree to these Terms and our Privacy Policy.
WhaleWatch is a sports-market intelligence and portfolio-analytics platform. We provide data visualization, market comparison tools, betting-line movement tracking, and decision-quality analytics. We do not operate a sportsbook, bookmaker, casino, or other gambling service. We do not accept wagers, hold player funds, offer odds, settle bets, or pay out winnings on any sporting event. You must be at least 21 years old and located in a jurisdiction where accessing sports-betting information and analytics services is lawful. By using the Service, you represent and warrant that you meet these requirements. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction.
To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect are compromised or abusive.
You agree to use the Service only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy. Prohibited conduct includes, but is not limited to: scraping, automated data harvesting, reverse engineering, attempting to circumvent tier or rate limits, reselling or redistributing our data, using the Service to facilitate automated wagering, harassment, or any activity that could damage, disable, or impair the Service.
Some features of the Service require a paid subscription. Fees, billing cycles, and plan features are described on our Pricing page and in our Billing Policy. Subscriptions renew automatically until cancelled. You may cancel at any time through the Stripe customer portal. All payments are processed by Stripe; we do not store payment card information.
The Service and its original content, features, data models, and functionality are owned by WhaleWatch and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. You retain ownership of any data you input into the Service, subject to the license granted to us to operate, store, and analyze it for the purpose of providing the Service.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of your information as described therein.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. ALL CONTENT, MARKET DATA, SCORES, AND ANALYTICS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE GAMBLING, INVESTMENT, OR FINANCIAL ADVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHALEWATCH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless WhaleWatch and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising from these Terms or the Service will be resolved exclusively through binding arbitration in Chicago, Illinois, except that either party may seek injunctive relief in a court of competent jurisdiction.
We may modify these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms.
